Jozikids Advertisers Terms and Conditions

Www.jozikids.co.za ("Jozikids") offers on-line listing of commercial providers of goods and services ("Advertiser"). Listing on the Jozikids website is subject to the following terms and conditions.


1.

The entire contents of the Jozikids website is copyrighted.


2.

Jozikids is not responsible for the design, maintenance or content of an Advertiser's advertisements and / or web site.


3.

Jozikids does not investigate any of the parties whose sites are listed and does not make any guaranty or warranty or assume any liability or responsibility for any such listing, nor can Jozikids assist in complaints by any user of the listed information.


4.

All Advertisers agree that Jozikids shall not be liable for any direct, incidental, consequential, indirect or punitive damages arising out of the use of any services or goods listed on the Jozikids site.


5. PAYMENT

  • Invoicing is on a calendar month option or on a discounted annual payment option.
  • Monthly payments must be paid in advance, before the 1st of every month and no later than the 8th day of each respective month.
  • Jozikids reserves the right to deactivate your advert from the website for accounts in arrears of 30 days from the issuing of invoice, until payment of the full amount outstanding as well as proof thereof is received.
  • In relation to (c) above, the onus is on the lister to alert Jozikids to the fact that payment of arrears amounts have been made.
  • In the case of an Advert being initiated after the 8th day of a particular month, invoicing will only commence with the next calendar month, i.e. the month of initiation will be deemed to be free.
  • Annual payments are payable up front and in full for a 12 month listing period.
  • Annual payments are non-refundable, regardless of the reason for the discontinuation of the Advert.
  • Jozikids shall not be liable for the repayment of any annual payments should Jozikids for any reason whatsoever no longer be in a position to provide the Advert service.
  • If any amount due and payable by the Advertiser is not paid within the agreed term (payment on delivery of invoice), the Advertiser shall be liable for interest at a rate of 2% above the prime lending rate of First National Bank.
  • Once annual or 6 monthly subscriptions come to end, unless specifically cancelled by way of 1 month's written notice, the subscription will continue on a month to month basis. The lister agrees that the subscription continues monthly unless specifically canceled in writing.

6. CANCELLATION OF AN Advert

  • Written notice to effect cancellation must be given on or before the 1st (first) day of the notice month.
  • Notice of cancellation of the Advert must be in writing and must be faxed to 086 5169136 or e-mailed to info@jozikids.co.za.
  • Jozikids will confirm the cancellation within 3 days of receipt of the notice to effect cancellation. If confirmation is not received from Jozikids within 3 days, the Advertiser shall correspond with Jozikids to establish if the notice of cancellation has in fact been received by Jozikids.


7. SOCIAL MEDIA

  • Jozikids may at its own discretion, change rules and regulations relating to social media posts as and if necessary. All listers will need to adhere to these rules at all times.
  • Jozikids reserves the right to delete or 'block' posts at its own discretion.
  • Social media platforms are constantly evolving to provide the best exposure and usage to users of their platforms. Jozikids reserves the right to change policies regarding social media posts on their own accounts, which includes Instagram, Facebook and Twitter, as and when necessary.
  • Jozikids and its staff continuously strive to remain informed and educated about the most efficient marketing strategies regarding social media for businesses. Therefore, in order to provide the most beneficial publicity/coverage for its listers, Jozikids will need to keep abreast with changes on social media platforms.
  • Any changes in policy relating to social media are deemed to be necessary, for the benefit of itself and/or its listers.

8.

In the event of Jozikids attorneys having to collect from the Advertiser an amount owing to Jozikids, the Advertiser agrees to pay all costs on the scale as between attorney and own client, including collection charges.


9.

Any agreement purporting to vary the terms of these conditions or any consensual cancellation shall not be valid unless reduced to writing and signed by both the Advertiser and Jozikids.


10.

Jozikids can, at its discretion, reject an Advert if it is deemed to be untruthful or obectionable in subject matter or wording or unsuitable for any other reason.


11.

Jozikids reserves the right to take their network of sites off-line for up to two days at a time for upgrading or maintenance without notice or compensation.


12.

  • Jozikids reserves the right to cancel the contract between itself and any of its advertisers, for any reason it may be deemed necessary to cancel.
  • Notice of cancellation will be given to the advertiser, in writing, on the day on which the advert is to be deactivated.
  • Jozikids is under no obligation to offer any explanation as to why the contract is being cancelled as referred to in 11(a) above.
  • Should the advertiser be owed any amount in regard to monthly or annual fees, such fees will be credited to the advertiser within one (1) week of notice of cancellation from jozikids to the advertiser.
  • Should the advertiser owe any monies to Jozikids in lieu of fees for advertising, such amount will be payable to Jozikids within one (1) week of notice of cancellation from Jozikids, as described in (b) above.

13.

Jozikids and its staff reserve the right to refuse any listing related to the advertisement of pyramid schemes and the like. Furthermore, jozikids is not under any obligation to explain the reasons behind refusing to allow advertising of such pyramid schemes and similar businesses. These decisions are solely at the discretion of Jozikids and its staff.
